Please read these Terms of Service carefully before placing an order or using this website. By accessing modernstandard.life or making a purchase, you agree to be bound by these terms.

 

1. About Us

Modern Standard is a clothing and lifestyle brand (referred to in these Terms as “we”, “us”, or “our”). Our website is located at modernstandard.life.

These Terms of Service (“Terms”) govern your use of our website and your purchase of products from us. They are governed by the laws of England and Wales.

 

2. Acceptance of Terms

By visiting our website, creating an account, or placing an order, you confirm that you:

        are at least 18 years of age, or have the consent of a parent or guardian;

        have read and understood these Terms and agree to be bound by them;

        accept our Privacy Policy, which is incorporated into these Terms by reference.

We reserve the right to update these Terms at any time. The version in force at the time of your order will apply to that purchase. Continued use of the website after changes are posted constitutes acceptance of the revised Terms.

 

3. Products and Orders

3.1  Product Descriptions

All products are produced on a print-on-demand basis by third-party fulfilment partners. We take reasonable care to ensure product descriptions, images, and sizing information are accurate. However, due to the nature of print-on-demand production, minor variations in colour, print placement, or texture may occur between batches. These variations do not constitute a defect.

3.2  Placing an Order

When you place an order, you are making an offer to purchase the relevant products at the stated price. We will confirm receipt of your order by email. A binding contract is formed only when we confirm despatch of your order.

We reserve the right to refuse or cancel any order at our discretion, including where:

        a product is listed at an incorrect price due to a typographical or technical error;

        we are unable to verify payment;

        the order appears to be fraudulent or placed in bad faith;

        a product becomes unavailable through our fulfilment partner.

If we cancel your order after payment has been taken, we will issue a full refund within 14 days.

3.3  Pricing

All prices are displayed in GBP (£) and include VAT where applicable. Delivery charges are additional and shown at checkout. We reserve the right to change prices at any time. The price applicable is the one shown at the time you place your order.

3.4  Availability

Products are subject to availability. As we use print-on-demand fulfilment, most products are available continuously. Limited edition or time-restricted drops will be clearly labelled, and availability will cease at the stated closing time.

 

4. Payment

We accept payment by the methods shown at checkout (which may include major debit and credit cards, and digital wallets). Payment is processed securely via Shopify Payments or another PCI-DSS-compliant gateway. We do not store your card details.

Payment is taken at the time of order. If payment is declined, your order will not be processed.

 

5. Delivery

5.1  Fulfilment

Orders are fulfilled and despatched by our print-on-demand partners. Estimated production time is typically 2–5 business days before despatch. Delivery timescales are estimates only and not guaranteed.

5.2  UK Delivery

Standard delivery to UK addresses typically takes 3–7 business days from despatch. Expedited options may be available at checkout.

5.3  International Delivery

We ship to selected international destinations including the United States. International orders may be subject to customs duties, import taxes, or other charges levied by the destination country. These charges are the sole responsibility of the recipient. We are not responsible for delays caused by customs processing.

5.4  Risk and Title

Risk in the products passes to you on delivery. Legal title passes to you once we have received full payment.

5.5  Failed Delivery

If a delivery is returned to us due to an incorrect address provided by you or failure to collect from a delivery point, we may charge for re-despatch. If you choose not to have the order re-despatched, we will refund the product cost but not the original delivery charge.

 

6. Returns, Refunds, and Your Statutory Rights

As a consumer in the UK, you have statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Nothing in these Terms affects those rights.

 

6.1  Right to Cancel (Cooling-Off Period)

You have the right to cancel your order within 14 days of receiving your goods without giving a reason, unless the products are personalised or made to your specification (see 6.2 below).

To exercise this right, you must notify us clearly within 14 days of receipt at hello@modernstandard.life. You must then return the items within 14 days of notifying us. Return postage costs are your responsibility unless the item is faulty or not as described.

We will issue a full refund of the product price and standard delivery charge within 14 days of receiving the returned items, using the same payment method you used.

6.2  Personalised or Custom Items

The right to cancel does not apply to products that have been made to your personal specification or clearly personalised. Standard catalogue products sold via our store are not considered personalised for this purpose unless you have submitted custom artwork or text.

6.3  Faulty or Incorrect Items

If your item arrives damaged, defective, or not as described, please contact us within 30 days of receipt at hello@modernstandard.life with your order number and a photograph of the issue. We will arrange a replacement or full refund at no cost to you. You do not need to return faulty items unless we specifically request this.

6.4  Non-Returnable Items

For hygiene reasons, we cannot accept returns of items that have been washed, worn (other than to try on), or otherwise used, unless they are faulty.

6.5  Refund Processing

Refunds are processed to the original payment method within 14 days of our receipt of the returned goods, or confirmation of a valid cancellation where no return is required.

 

7. Intellectual Property

All content on modernstandard.life — including designs, graphics, slogans, copy, images, logos, and the ‘Modern Standard’ name and brand — is owned by or licensed to us and is protected by copyright, trade mark, and other intellectual property laws.

You may not reproduce, distribute, or use any of our content without our prior written consent. You may share links to our website and share our social media content in accordance with those platforms’ terms.

8. Use of the Website

You agree not to use this website:

        in any way that breaches applicable local, national, or international law;

        to transmit unsolicited commercial communications;

        to attempt to gain unauthorised access to any part of the website or its infrastructure;

        in any manner that could disable, overburden, or impair the website;

        to scrape, copy, or extract data from the website using automated means.

We reserve the right to restrict or terminate access to the website at any time and for any reason.

 

9. Limitation of Liability

To the fullest extent permitted by law:

        We are not liable for any indirect, consequential, or special losses arising from your use of this website or our products;

        Our total liability to you for any claim arising from a purchase shall not exceed the price you paid for the relevant order;

        We do not exclude liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

The website and its content are provided “as is”. We make no warranty that the website will be uninterrupted, error-free, or free of viruses.

 

10. Privacy and Data

We collect and process personal data in accordance with our Privacy Policy, available at modernstandard.life/privacy. By using the website, you consent to such processing and you warrant that all data provided by you is accurate.

We use Shopify to operate our store. Shopify’s privacy practices are governed by their own privacy policy. We use your data only to process orders, manage customer accounts, and communicate with you about your purchases or (with your consent) marketing.

11. Mobile Terms of Service

The Modern Standard mobile message service (the "Service") is operated by Modern Standard (“Modern Standard”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Modern Standard’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Modern Standard through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Modern Standard. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to Modern Std or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Modern Standard mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

For Service support or assistance, text HELP to Modern Std or email hello@modernstandard.life.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from these Terms or your use of this website shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We are committed to resolving disputes fairly. If you have a complaint, please contact us first at hello@modernstandard.life. If we cannot resolve it, you may be entitled to use an alternative dispute resolution (ADR) scheme. As we sell via Shopify, the EU Online Dispute Resolution platform is available for EU-based customers at https://ec.europa.eu/consumers/odr.

 

13. Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right under these Terms shall not constitute a waiver of that right.

These Terms constitute the entire agreement between us relating to your use of this website and supersede all previous agreements.
